Introduction
  1. The sole purpose of this portal is to provide the platform as a preliminary medium of contact and exchange of information for its users/members/visitors/subscribers/candidates who have a bonafide intention to contact and/or be contacted for the purposes related to genuine existing job vacancies in the aviation industry and for other career enhancement services.
  2. If you do not accept these Terms and Conditions or you do not meet or comply with their provisions, you may not use the SRBS air wing airways Services Private Limited(“Wing Airways”) Web Sites or Services. These Terms and Conditions will be effective for all time till it is revoked or modified by air wing airways.

Introduction
  1. To become a Priority Applicant, the Candidates/Subscribers are required to pay a nominal registration fee towards the HR Consultant Charges and providing facilitation in exploring the appropriate job opportunities in the aviation industry.
  2. The payment for service once subscribed to by the Priority Applicant is not refundable under any circumstances and any amount paid by the Candidate/Subscriber shall stand appropriated.
  3. This subscription amount paid by the Priority Applicant is not transferable i.e., it is for the same person throughout the period of subscription.
  4. air wing airways will commence providing services only upon receipt of amount/charges upfront either from the Priority Applicant or from a third party on behalf of the Priority Applicant.
  5. The Priority Applicant mentioned here in above have to undergo a simple test and thereafter Interview will be conducted by the HR Executive of air wing airways so as to shortlist and/or prepare the illegible and competent Candidates for further processing regarding the potential job opportunities.

  6. The Priority Applicant represent, warrant and agree that he/she (a) is at least 18 years of age or older, and if under the age of 18 or the age of majority, the Priority Applicant will only use the Sites and Services under the supervision of a parent, legal guardian, or other responsible adult; and (b) will not use (or plan, encourage or help others to use) the Sites for any purpose or in any manner that is prohibited by these Terms and Conditions or by applicable law. It is the responsibility of the Priority Applicant to ensure that the use of the website complies with these Terms and Conditions and all applicable laws.
  7. The shortlisted Candidate will be required to undertake the Training Program/Course at the Training Institute(s) affiliated with air wing airways in their area of interest in order to gain experience in the intricacies of the particular job profile. The Priority Applicants are also required to pay a fixed fee for their opted Training Program/Course.
  8. The payments for the Training Program/Course at the Training Institute(s) affiliated with air wing airways shall be on a 100% advance basis. However, air wing airways has also provided an option of payment of fee in three equal installments to the Priority Applicant. air wing airways reserves its right to amend / alter or change all or any disclaimers or terms of agreements at any time without any prior notice. All terms/disclaimers whether specifically mentioned or not shall be deemed to be included if any reference is made to them.
  9. Pursuant to successful completion of the Training Program/Course opted by the Priority Applicant in their particular area of interest, air wing airways will provide assistance to the Priority Applicant for placement in the job opportunities available in the aviation industry which also includes the potential job opportunities to the deserving Candidates in air wing airways.
  10. The services provided by the websites maintained, operated or owned by air wing airways do not extend to acting as an agent (express or implied) on behalf of any Candidate/Subscriber or user.
  11. This service shall not be utilized by the user for uploading/transmitting content which is illegal or objectionable in any manner.
  12. Nothing on the website of the air wing airways shall be considered an endorsement, representation or warranty with respect to any User or third party, whether in regards to its web site, products, services, hiring, experience, employment or recruiting practices, or otherwise.

    13. Liabilities & Rights
  13. The website of air wing airways is provided on “As is” basis without providing any warranties of any kind, express or implied.
  14. The User of the services of air wing airways shall not claim any copyright or other Intellectual Property Rights over the data uploaded by him/her on the website of Wing Airways.
  15. The Candidate/Subscriber further represents and warrants & assures that, the data provided by the Candidate/Subscriber for the purpose of uploading in the Website, shall not be violative of any IPR, rights of privacy, rights of publicity and/or any other rights of third party and shall not be violative of any provision of Law in force.
  16. The Candidate/User/Subscriber/Visitor to info@airwingairways.com and/or its affiliated websites does hereby specifically agree that he/she shall, at all times, comply with the requirements of the Information Technology Act, 2000 as also rules, regulations, guidelines, bye laws and notifications made thereunder, while assessing or feeding any resume/insertion or information/data into the computers, computer systems or computer network of air wing airways. The said Candidate/User/Subscriber/Visitor to airwingairways.com and/or its affiliated websites does further unequivocally declare that in case he violates any provisions of the Information Technology Act, 2000 and/or rules, regulations, guidelines, by laws and notifications made thereunder, he shall alone be responsible for all his acts, deeds and things and that he alone shall be liable for civil and criminal liability there under or under any other law for the time being in force.
  17. air wing airways makes no representations or guarantees regarding the effectiveness of the services or timeliness of the services in meeting the employment objectives of the Candidates/Subscribers. air wing airways does not guarantee that the services will result in candidates being hired, positions being filled or employees being retained, and is not responsible or liable for any employment, hiring and/or salary decisions, for whatever reason made, made by you. It is made clear that the Candidates/Subscribers opting for registration to avail the services of the HR consultant of air wing airways, should not treat this service as a surety of job by air wing airways.

  18. In case a person using the world wide web/internet receives a spam or virus which includes a link to info@ingairways.com or to any other site maintained, operated or owned by air wing airways, it should not be held responsible for the same. air wing airways assumes no responsibility for such mails.
  19. The Terms and conditions mentioned above regulate the usage of info@airwingairways.com job portal. Any person using info@airwingairways.com in violation of the stipulations contained in the Terms and Conditions of info@airwingairways.com shall render himself/herself liable to appropriate action in a court of law both civil and criminal.
  20. air wing airways hereby grants a limited, terminable, non-exclusive right to access and use this portal only for the personal use seeking employment opportunities. The Candidates/Subscribers agree that he/she are solely responsible for the content of any document post to a Site and any consequences arising from such posting. Your use of the website is a privilege. air wing airways reserves the right to suspend or terminate that privilege for any reason at any time, in its sole discretion. The Candidate/Subscriber undertakes that the data/information provided by him is true and correct in all respects.
  21. In case air wing airways is implicated in any legal proceedings, costs will be recovered from the party that names air wing airways. air wing airways however will abide with any court order served on it through due process. air wing airways controls and operates this Platform from its headquarters in Noida and makes no representation that the materials on this website are appropriate or available for use in other locations. If you use this Website from other locations, you are responsible for compliance with applicable local laws.

    22. Termination
  22. The Company may terminate the Services in case the Candidate/Subscriber:
  23. Commits any breach of these terms and condition, representation & warranties and Subscriber’s obligations as contemplated in this agreement.
  24. Fails to make payments as per the terms & condition herein.
  25. Uses the Services provided by air wing airways for any illegal, unlawful or immoral purposes or in any fraudulent manner or for purposes not authorized by air wing airways.
  26. The Candidate/Subscriber shall keep in confidence any information received by the Candidate/Subscriber under this agreement, irrespective of the business or the matters concerning the other and shall not disclose the same to any third party, save and except to any State or Central Government or to any of their agencies and/or any other concerned legal and other competent authorities on specific demand or under a general obligation.
  27. Advice received from regulatory or any other competent authorities.
  28. Commits violation of any Intellectual Property Rights, rights of privacy, rights of publicity and/or any other rights of third party and shall not be violative of any provision of Law in force.

    29. Force Majeure
  29. air wing airways would not be held liable for any loss of data technical or otherwise, information, particulars supplied by the Candidate/Subscriber due to the reasons beyond its control like corruption of data as a result of any causes or conditions that are beyond the air wing airways' reasonable control including but not limited to acts of Government, acts of God, Govt. policies, tampering of data by third party like hackers, terrorism or by viruses or Computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. In no event will the air wing airways be liable for any such direct/indirect/consequential loss or damages, including loss of profit or loss of reputation/defamation, even if advised of the possibility thereof.

    30. Dispute Resolution
  30. air wing airways would not be held liable for any loss of data technical or otherwise, information, particulars supplied by the Candidate/Subscriber due to the reasons beyond its control like corruption of data as a result of any causes or conditions that are beyond the air wing airways' reasonable control including but not limited to acts of Government, acts of God, Govt. policies, tampering of data by third party like hackers, terrorism or by viruses or Computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. In no event will the air wing airways be liable for any such direct/indirect/consequential loss or damages, including loss of profit or loss of reputation/defamation, even if advised of the possibility thereof.
  31. By accepting these terms and conditions, you agree to indemnify and otherwise hold harmless air wing airways, its directors, officers, employers, agents, subsidiaries, affiliates and other partners from any direct, indirect, incidental, special, consequential or exemplary damages arising out of, relating to, or resulting from your use of the services obtained through info@airwingairways.com including but not limited to information provided by you or any other matter relating to info@airwingairways.com
  32. If any dispute arises between a User/Users and air wing airways arising out of use of info@airwingairways.com or thereafter, in connection with the validity, interpretation, implementation or alleged breach of any provision of these Terms and Conditions, the dispute shall be referred to a sole arbitrator who shall be an independent and neutral third party identified by the Company. Decision of the arbitrator shall be final and binding on both the parties to the dispute. The place of arbitration shall be New Delhi, India. The Arbitration & Conciliation Act, 1996 as amended, shall govern the arbitration proceedings.
  33. These Terms and Conditions shall be governed by the laws of Republic of India. The exclusive forum for any disputes arising out of or relating to these Terms and conditions shall be a court of law located in New Delhi, India.
